Dear Mr. Palma,

Please be advised that the common facilities of a subdivision, particularly all the roads and open spaces are turned over by the Developer to the Local Government Unit (LGU) when the project is already finished and is already issued a Certificate of Completion (COC) by the Housing and Land Use Regulatory Board (HLURB). This procedure is to relieve the Developer of all the duties and responsibilities in maintaining these facilities of the subdivision.

Now, if the Homeowners' Association (HOA) of the subdivision wants to take over and shoulder the maintenance and management of these common areas, the HOA could enter into a Memorandum of Agreement (MOA) with the LGU to effect such transfer of management and responsibility.
