Dear sir/madam:
im an individual build and sell in multinational village, one day my sister got a client,.filipina with a husband korean.
They saw my house in multinational ..and they negotiate for a good discount coz it is cash basis...im selling it by 3.5million...and they asked for a discount of 500 , so i agree for the amount of 3 million .The house is near to finished when they saw it...so they request for the additional improvement to apply for like , installed all ceiling lights , gate, tiles for the garage, curtain,drill for the windows. ....and they gave a earnest money of 100 thousand pesos and i gave a receipt only without the agreement yet , dated Oct. 2 2007....and the second payment will be Nov. 30 , 2007 for the amount of 1.4million ...and the third one will be on April 30, 2008 for the amount of 1.5mil....for a total of 3million.
Nov. 30, 2007 arrived ,they did not pay me , for the reason that the house is still not complete, since it is only the hand drill of the stairs and gate only is left..but then, the wife send her new set of furniture and bedroom accessories plus the a huge split type aircondition and fix it in the house.
Still im giving to them a contract to sell for them to sign and gave the next payment that we verbally agree last Oct. 2 , so they didnt signed and they told me that the certified true copy of the title is not real ,,and im just stamp it in anywhere...... i just continue to finished the house..., just to make them satisfied.........
December 15, 2007 ..the house is finished ,,and they want to transfer by December 25, 2007 ..but i refused coz they are not paying me but they like to transfer .........and beside i m segregating the title for two...........and only technical description is on my hand........and because of Christmas season.....so i only finished it last Jan. 15, 2008..
So , they cannot wait and finally they decided to quit and asked for a refundable...when the husband arrived , last Jan. 8 , 2008 and we talk by phone that they need their money back at once.And without my knowledge, they file a demand letter for me to return within 10 days......which i havent received it...
So when the korean husband arrived last jan. 8, and we talk hardly....he dont like to agree,,that i can only return ur money if the house will be sold out.......
The following 2 days , Jan 10, 2008 around 10 am , they went to my house with a policeman and one big guy....and the filipina and the korean husband. The korean knock on my window , so sharply just to open it...which im inside and didnt hear them....
when i open..i got shock coz they brought a policeman....
If i will not give their money , they will sue me to the court.....
Since i have no plans not to return it ,,even my marketing was stop due to their reservation,, or earnest money ,,and they posses the house by putting their furniture....for 3 months ,,im still willing to give....but if the house will be sold out.
The policeman talk to me ,,what we gonna do....because im alone inside my house and feel nervous..........i signed anything for them to leave.........as a promisory note that i will return the money by march. 3..2008...
Unfortunately, the house still not sold out so i failed to return it.....and now they are filing a case against me for a stafa.
What would be my standing now, im very broke until now, even the tuition fee of my children i didnt pay yet, all my credit card are not been pay.......im vey very broke...since they quit to buy the house and lot and the prospective buyer that im supposed to give the house ,,is already buy new one...coz of my commitment with them .....and i honor the 100 thousand they gave........if i only knew that they will quit after 3 months ,,then i should giving it to the other buyer...earlier,
What shall i do...the hearing in fiscal is nearest by August 5,2008..
and i can t get any lawyer to reply for the counter affidavit.
Pls. give me some advice ,,of my standing regarding this matter.....
