I want to add more questions related to this because this sounds like the same subdivision I bought a lot some time ago in Cavite.
I started to receive monthly association dues from the supposedly HOA but it looks like the letter came from the developer. So I decided to ignore it.
1. I don't see the HOA in the Masterlist of Registered HOA. Why can't I see most subdivisions' HOA in Cavite here? Does this mean they are not legal? How do I check?
2. The 'HOA' continue to send me billing statement and the amount have grown due to interest, penalties and charges. Now I'm being threatened that legal actions will be taken. I'm asked to pay at the 'Village Administration Office" or to a certain bank account no. Again, this raised doubts that it came from the developer and not the official HOA. Should I pay?
3. I am currently out of the country. What can I do? I know that once I pay, my money will be gone even if the HOA is illegitimate.
4. I have already fully paid the lot and up to date on gov't realty taxes. I also have the TCT under my name. If the HOA is legitimate can they take control of my lot?
I used to live in another subdivision and had a similar experience. Found out that some homeowners who run for HOA positions are in connivance with the developer to collect monthly dues, security and maintenance from homeowners and unsuspecting lot owners. Even threatened to cut water for not paying. There was a long discussions/battle at HLURB, not sure what happened. Last thing I know was no one was paying the dues and no more security and maintenance. One of the reasons I left.
Please advise what I should do to avoid being a victim instead of being a proud lot owner.
