to whom i can address my complaint against a developer who:
1. forfeited my purchase without me receiving a verbal and written notification or warning that my purchase will be forfeited.
2. did not fully disclosed a critical information (pricing) that a buyer should know.
i purchased a property thru installment from a developer and already paid the downpayment in full. the developer forfeited the purchase because it was not clear as to who will finance the balance.
according to the developer, they did sent a notice three times but it was being returned to them. i found out that the notices were sent to an old address so definitely i won't be able to receive them. the developer was advised that we will be moving to a different address and my wife provided a contact number where we can be easily reached as we don't know the exact address yet where we are moving.
obviously, the developer didn't made an extra effort to contact us thru the number my wife gave when the first notice they sent was returned to them. worst, they sent a second and third notice to the same old address. my wife and i just found out that the purchase was forfeited when we went to the developer's office.
i already made a complaint to the developer and they agreed to "reactivate" the account for a fee which we paid but frustated upon learning that the price had increased to about P200,000. worst, the developer did not disclose to us that the price increased. i only learned about it when i noticed a discrepancy in the purchase price on one of the documents which i was about to sign.
does HLURB has jurisdiction over this case? what HLURB can do for me? thanks a lot!
