I had been paying for a my unit at cambridge village since 2005. I am having financial difficulties right now and I want to cash surrender the payment I made and avail of the fifty percent refund as provided by the Maceda Law. The developer told me that my Contract to Buy and sell entitle the Company to forfeit all my payments as liquidated damages. In my understanding, the MACEDA LAW was made to protect buyers like me from one-sided contract stipulations issued by developers who forfeit all payments made and sell the same property for the same price (or higher).

Does the Contract waive the RA 6552? What possible actions can I do to avail of the said refund? Where can I get legal help?
