i want to know whether or not my case is governed by Section 3 of RA6552, i.e., if i had already paid at least 2 yrs of installment payments for me to be entitled to the refund of cash surrender value.i have the ff questions:
1.how would the buyer know if he/she has already paid at least two years of installment payments?
2.is there a standard computation for it? is this the only computation?exceptions, if any?
3.is there already a decision by the high court regarding this computation so that we can include it in our complaint?
4.if there was a schedule of monthly amortization included in the contract to sell, will this be followed to determine whether or not there has been at least two years of installment payments made hence buyer entitled to the refund of cash surrender value? or the standard computation (if there be any) prevails?
