Cancellation of Contract to Sell

The developer promised several times in writing to complete the unit but still unable up to this point in time. Hence, we informed (in writing) the developer that we are holding our payment until they have completed the unit. We also have a concern on the construction which we ask them to resolve but we have not receive any response from them.

Questions:

1. Can we cancel the contract to sell?

2. Are we entitled to compensation aside from the interest to our payments? How long it will take to recover our payment?

3. Do we need to go through litigation or HLURB arbitration?

Also please advise how long it will take to settle such issues.
