exclusive contracts

Our subdivision is new, thus there is no homeowners association yet. Some units are still being built. In the absence of any stipulation in the contract to sell, does a developer have the right or authority to enter into an exclusive contract with a service provider? In particular, our developer has a contract with Skycable to provide exclusive cable service to homeowners. The subscribers pay the regular rate, i.e., no special fee was granted to the homeowners. The developer is also silent as to when the contract lasts.

Please shed light to this matter.
