We are victim of a fly by night developer. Actually we have a complain filed in your Cebu office Leysonville homeowners against ATB Realty & Development Corporation headed by Jocelyn T. Apurado, and as of now we are still waiting for the HLURB Board decission of our case for 2 months already.
My question is , how are we protected by the law if we bought a lot and after we completed all the payments, the contract between the original lot owner and the developer was forfeited due to breach of contract? Does the original lot owner has the right to take back our lot that we bought from the developer because the developer did not pay him? Just for your information the developer was not issued a license to sell from the HLURB because they failed to comply the requirements. Now the original lot owner decided to take over the developement of the subdivision where we bought our lot but the lot owner demanded from us to pay again the same price to them before they give as our deed of sale and lot title. Do they have the right to do this? im sorry my message is too long.. Thanks in advance..
