Where can I get copies of residential subdivision documents pertaining to designated use of "open space" delineated in a plan for Subdivision project initiated sometime in 1968?
I am particularly concerned if the provision of P.D. 1216 section 31 that took effect in 1977 and provides exclusive allocation for parks, playgrounds and recreational use in such "open space" can be applied. My mother and aunt bought lots in one such residential subdivision during the start of its development phase and were given copies of subdivision plan indicating among others the roads and open space. During the transaction period, they were informed by the owner/developer that the open space so delineated in the plan will be developed as playgrounds and parks for the common use of all lot buyers.
Unfortunately, the open space is now the location of several public school buildings.
