May I bring to the attention of the concerned HLURB officer the following problems of the homeowners in Benjamin Village II, Barangay Graceville, City of San Jose Del Monte. These problems have been brought to the attention of the developer a number of times yet there is inaction on the part of the latter. I moved to the subdivision in April 2003, and there has been no development ever since, apart from occasional grass cutting in the area.


1. Absence of Safe and Potable Water Supply. The water delivery service being made by the developer is insufficient and inefficient. The water is NOT even fit for human consumption. The homeowners incur additional costs to purchase drinking water from refilling stations. There are many times when the jeepney (it's not even a delivery truck!) being used for water delivery is not in working condition, and the driver would ask the homeowners if it would be possible for us to shoulder the repair of said jeepney. In fact, for the past several months that jeepney is no longer making the rounds. We have no recourse but to purchase water from commercial water tankers which charge us even more. Isn't water system a basic facility that the developer should provide its homeowners?


2. Insufficient Power Supply. Many of our appliances have been damaged because of fluctuating power supply. Like its promise to give us safe and potable water, its promise to deliver sufficient power supply seemed to have been forgotten. There are no concrete electrical posts such that we have to construct make-shift posts to bring the electric cable from the main post to our house.

3. Open manholes. Our children are exposed to the dangers of falling into these open manholes which are all around the village. Some were left open, some had covers earlier but were either intentionally damaged by passers-by or unintentionally damaged by passing vehicles.

5. Potholed main road. The main road is full of pot holes, deep and large. Our personal vehicles have to struggle getting through these pot holes, and it is always a bumpy ride on tricycles that enter the subdivision. It is more difficult to negotiate these potholes during the rainy season. The rainy season, incidentally, brings muck and mud from the undeveloped areas of the village to the main road.

6. Unpaved alleys. Up to this time, many alleys remain unpaved; thus, these cannot be used by the village residents especially during the rainy season when these alleys are deep in mud.

7. Absence of no perimeter fence and dimly-lighted, if not dark, streets and alleys. We do not wish to be prejudiced against non-residents but we are overcome by the need to protect our homes, our properties, and our families. Every day, we are exposed to the dangers of theft and robbery. In fact, there are many instances where many of us have been robbed in broad daylight. Incidentally, my electric cable was stolen thrice in the past year.

The marketing materials that were distributed in the developer's sales and promotion activities were enticing enough to have made me purchase a piece of property in Benjamin Village II. I expected safe and potable water supply flowing from our faucets, sufficient power supply for our appliances, security for our homes, properties, and families and well-paved roads and alleys. I expected to live in a subdivision that we can be proud to show off to our relatives and friends. To say that I am both angry and frustrated is an understatement.

Thus, I, as an affected and suffering homeowner of said subdivision, am bringing the aforesaid issues to HLURB's attention with the hope that you will be able to act on these issues with dispatch. These issues have been nagging the homeowners for several years now and it is very exasperating and infuriating to be given the run-around in the past.

Lastly, what are my remedies under the law? Can I suspend payments of amortization? I bought two lots in the said subdivision where our house now stands. I have already paid for one lot in June, 2006 but the developer did not accept my full payment pending issuance of the clean title. Until when are they allowed to give me my clean copy of the title, considering that I offered full payment of the first lot? There are other homeowners who have already paid the lots for so many years now but have not yet been issued the title. I have suspended payment for the second lot because of doubts about whether they really have the title that they can rightfully transfer to me but I have not given the developer notice about the suspension. Can they cancel the sale on the second lot on this ground?
