We'd like to seek your opinion re: unpaid association dues of the previous owner of the foreclosed property we bought. Kindly guide us on the following queries:
Are we liable to pay the unpaid association dues incurred by the previous owner prior to our acquisition?
or is it the bank who should shoulder the same?
Would the bank be liable only from the time of foreclosure or from the time the title has been consolidated ?
Do you have any rules/legal basis exempting the new buyer or the bank from paying the said dues considering that the said dues pertain to a period when the unit was still occupied by the previous owner?
May we also know the basis for holding the new buyer or bank liable for the unpaid dues of the previous owner?
Do we have any remedy or defense in case we are held liable to pay the unpaid dues of the previous owner?
We would really appreciate your guidance on this matter.
