HLURB Conducts Consultation Workshops on Proposed Framework of Governance for Homeowners Association

The Board will be conducting a series of three regional cluster consultation workshops leading to the adoption of a proposed Framework of Governance for Homeowners Associations . This was disclosed by Director Charito M. Bunagan - Lansang , Board Secretary and Project Manager of the Special Project for the Adoption of a Framework of Governance for HOA ( Special Project No. 3 ) of the HLURB, who oriented the participants as to the rationale and objectives, as well as the salient points of the said framework . during the first consultation workshop held last July 13, 2004 at the Quezon Ballroom of the Sulo Hotel in Quezon City.

The public consultations are in line with HLURB's implementation of its newest regulatory mandates consisting of the incorporation, registration, regulation and supervision of Homeowners Associations, pursuant to Section 26 of Republic Act No. 8763, in relation to Executive Order No. 535 Series of 1981 and Presidential Decree No. 902 -A.

It may be recalled that the authority to incorporate , regulate and supervise Homeowners Associations was originally a function of the Securities and Exchange Commission or SEC pursuant to Presidential Decree No. 902 -A in relation to the Corporation Code ( Batas Pambansa Blg. 68, as amended) . This was later transferred to the Home Financing Commission (later renamed as the Home Insurance and Guaranty Corporation or HIGC) pursuant to Executive Order No. 535 Series of 1981. With the reorganization of the HIGC into the Home Guaranty Corporation pursuant to its latest charter, Republic Act No. 8763 which toolk effet last March 23, 2000, the mandates of HGC over homeowners associations, which now included the Community Associations of the Community Mortgage Program (CMP) of the NHMFC, Group Land Acquisition and Development (GLAD) Program of the HDMF and the Land Tenure Assistane Program (LTAP) of the NHA were transferred to the HLURB.

In his opening remarks made during the said initial consultation workshop, Commissioner Francisco L. Dagnalan Commissioner for Legal and Homeowners Affairs of the Board, said that the formulation of the proposed Framework is in the nature of a technical assistance and capacity building project intended for the use and benefit of the homeowners associations, and was conceived with the following objectives in mind:

To clarify and delineate the role , policies, powers and responsibiliies of government , represented by the HLURB, as well as of homeowners associations under existing laws and regulations; with the end in view of enhancing government and association relations;
To promote and operationalize the principles and advocacies of the government's campaign on good governance which are applicable to and are suggested to be adopted by homeowners associations in their internal affairs, such as security from all forms of deprivation, efficiency, transparency and accountability and equity of participation in decision making, civic engagement and citizenship; and
To assist, enable and empower the officers and directors of homeowners associations in the management and operation of their organizations, and avoidance and settlement of association concerns and disputes, in line with the good governance principles of empowerment, subsidiarity and decentralization.

In response to earlier queries and reservations expressed by some groups of homeowners associations as to the jurisdiction of the HLURB in formulating the proposed framework, as well as the propriety and timeliness of such a framework, both Commissioner Dagnalan and Director Bunagan believe and stressed that the adoption of such proposed Framework of Governance is essential to avoid future misunderstanding in the course of the exercise by the Board of its powers and functions, as well as to decongest and minimize the growing number of complaints affecting or invoving homeowners associations, particularly the large backlog of cases of disputes between officers and members of various homeowners associations that have been inherited by the Board from its predecessor agencies. They also said that the proposed framework is the result of lessons learned from the Board's brief experience, and is a manifestation of the Board's desire to be more pro-active and efficacious in dealing with homeowners' concerns

On the matter of the on-going consultations, Director Bunagan revealed that the two remaining consultation - workshops will be held in the Visayas and Mindanao, to afford broader stakeholder equity . The next consultation will be at the Sarabia Manor Convention Center in Iloily City on July 22, 2004 , while the last one will be held at the Sydney Hotel in General Santos City on July 28, 2004 .

Invited to participate in these consultation workshops are Presidents and Officers of homeowners associations and federations, law practitioners handling homeowners cases, private developers' groups, national and local government officials, the academe and civil society groups.

Is it required for home owners to give a copy of ownership, or bank mortgage to the homeowners association as they said was requirement with HLURB. Board members said it is requirement to get Certificate of Membership. In giving said personal papers to the association an invasion of privacy of homeowners. Some board members might try use information of said homeowners. Please give me information on this matter.

I am residing in Mactan Country Homes, located in Timpolok, Babag, Lapu-lapu City, Cebu for five (5) years. My wife and I lived in this house whose registered buyer was my sister-in-law who is presently residing in Hongkong right now. Association's Election of Officers is done every June of each year. On the first week of June this year, I got elected as the Homeowners Association President, only to find out that this association was not registered in HLURB (the develor - Franzland Development Corporation- ceased to exist and was not able to complete the project, in short, the project was abandoned and many buyers who have paid in full have no titles right now, and some of the buyers don't know where to continue paying with their amortization), and for how many years this association acted like the real one. Can It still be registered even without a developer? Please send me also the Framework of Good Governance for HOA.

Homeowners Associations have been so much empowered that they can be used by abusive officers/people to gain financial and political power over the residents/would be residents of a subdivision. Classic examples are the complaints against HOAs entering into contracts with water connection developers which would tie the residents with excessive rates for years and the fexcessive fees imposed on those who would build houses and need HOa clearances

Good morning Sir!

I just want to ask my right regarding the lot i bought which is located on the fault line. The agent did not notify me that the said lot was not safe to build a house. I was advised only by the municipal Engineer that house construction is not feasible due to this fault line.
